Selected Consulting Examples:
  • Client had property in Atlantic City, New Jersey classified for casino use. Casino property is subject to the highest of all property tax rates. Client had no intention of using the property for casino development. Expert provided testimony that the future of casino gambling in Atlantic City was bleak and no more casinos would be economically viable in the near future. The result: clients property was reclassified for non-casino use and a $7 million property tax refund was issued.
  • A developer brought in a auction company to help stimulate sales of a hi-rise condominium project. Auction company made representations that an absolute auction was the best way to sell the units. The auction went very badly and destroyed the price structure of the entire building resulting in millions of dollars of losses for the developer. Developer sued the auction company in federal court for the losses. Auction company claimed that real estate auctions are last ditch effort to recoup money for a failed venture, and they did the best they could.Expert was brought in to refute auction company's claim and provide damage estimates for the losses. Expert 's testimony proved that auctions, if properly conducted, are an excellent way to increase the selling price of an item beyond it normal selling price. Expert's testimony also proved that absolute auctions can be extermely dangerous to the seller, if certain conditions are not met. The result: the developer received a multi-million dollar judgement against the auction company.
  • Re-licensing Hydroelectric damsWe have provided testimony concerning the benefits and costs of re-licensing hydroelectric facilities. Our testimony demonstrated that society would benefit from having the dams re-licensed for the purpose of generating electricity rather that to produce less electricity and offer more protection for different species of fish. Our findings that stood up to rigorous courtroom challenges even when efforts were made to overvalue the fish by various environmental concerns.
  • AuctionsOur expert reports and testimony have allowed injured real estate developers to collect a sizable settlement from a real estate auction company. Our testimony proved that the damage suffered were a direct result of a botched real estate auction held by the auctioneers. Our testimony demonstrated that the auctioneer overstated the benefits and the understated economics risks of holding a real estate auction. We demonstrated that contrary to the auctioneer's claims, auctions are not always the best way to raise seller's revenues and rebuffed the auctioneers claim that a depressed real estate market was responsible for the poor auction.
  • TourismExpert Economics has defended boat manufactures from breach of contract lawsuits from retail marine dealers. We demonstrated to the court that dealer incompetence, a disastrous national market, and a declining seasonal tourism industry were responsible for the dealers declining sales and eventual closing. The manufacture had no responsibility for the dealer's misfortune.
  • Real Estate and FinanceIn the real estate sector, our expert reports have saved the casino industry in Atlantic City millions of dollars in property taxes. We have testified in tax court that the highest and best use for land in Atlantic city is no longer for casinos; and therefore, the property should be valued and taxed at its much lower non-casino use.We have represented defendants in mortgage foreclosure lawsuits by demonstrating to the court that the mortgagee's initial calculations of monthly payments was inconsistent with the interest rate stated in the note. And, when the calculations are corrected the defendant had a much lower principal outstanding and was entitled to a refund. Furthermore, we demonstrated the Annual Percentage Rate contained in the Truth and Lending Statement was calculated incorrectly in violation of Regulation Z.
  • Matrimonial and EstateWe have valued matrimonial property in divorce settlements. One the areas in which we excel is valuing the assets of human capital investment, i.e., the value education, training and of advanced and professional degrees made by either spouse during the period of marriage. This often overlooked but very profitable asset needs to be valued and distributed equability between the two divorcing parties.Also, we have also valued estates and made recommendations for the equitable distribution of an estate among feuding heirs.
  • Discrimination/Sexual Harassment.In addition to estimating the loss of earnings and fringe benefits from current and past discrimination and sexual harassment, we explain and bring forth the sources and mechanisms behind discrimination and the incentives and disincentives, for firms to engage (or avoid) it. When necessary, we have provided high powered statistical analysis of a firms entire employee data base to show the base the presence or absence of discrimination by age, race, sex or disability.
